These Terms & Conditions apply to your use of the Wholesome Living AUS website and any purchase of products from us through our website.

By accessing our website or placing an order with us, you agree to be bound by these Terms & Conditions, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.

If you do not agree to these Terms & Conditions, please do not use our website.

  • some products may vary slightly from their images
  • all products are subject to availability

We reserve the right to limit the quantity of products purchased per order, per customer, or per household where reasonably necessary, including to protect against suspected fraud, unauthorised resale, or stock availability issues.

3. Pricing

All prices on our website are displayed in Australian Dollars (AUD) unless otherwise stated.

We reserve the right to change prices at any time before you place an order.

Prices do not necessarily include delivery charges unless expressly stated. Any applicable shipping costs will be shown at checkout before you complete your purchase.

If a pricing error occurs, we may cancel or refuse an order affected by the error, even if the order has been submitted. If payment has already been processed, we will refund the amount paid for the affected order.

4. Orders

When you place an order, you are making an offer to purchase the product(s) in accordance with these Terms.

We may accept or reject an order for legitimate reasons, including where:

  • there is an error in the product description or price
  • we suspect fraud, unauthorised activity, or breach of these Terms

If we cancel your order after payment has been received, we will refund the amount paid.

5. Payment

Payments are processed through third-party payment providers. By submitting payment details, you authorise the applicable payment provider to process payment for your order.

We do not store full credit card details ourselves unless stated otherwise through our payment provider arrangements.

6. Shipping and delivery

We will arrange shipping in accordance with our Shipping Policy.

Any delivery dates or timeframes provided are estimates only and may be affected by factors outside our control. To the maximum extent permitted by law, we are not liable for delay in delivery where the delay is caused by events outside our reasonable control.

Risk in the goods passes to you on delivery. Title in the goods passes to you once full payment has been received.

7. Returns, refunds and consumer guarantees

Our Returns & Refunds Policy applies to purchases made through our website.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law, including consumer guarantee rights. Consumer guarantees cannot be excluded by contract.

Where a product fails to meet a consumer guarantee under the Australian Consumer Law, you may be entitled to a repair, replacement or refund depending on whether the failure is major or minor.

Mandatory ACL wording for goods:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8. Promotions and discount codes

We may offer promotions, discount codes or special offers from time to time. Unless otherwise stated:

  • promotions are subject to availability
  • promotions cannot be used in conjunction with other offers
  • promotions are not redeemable for cash
  • we may modify, suspend or withdraw a promotion where reasonably necessary, including where there is an error or misuse

Our website may contain links to third-party websites or use third-party tools, apps or integrations.

  • in the case of goods: the replacement of the goods, repair of the goods, payment of the cost of replacing the goods, or payment of the cost of repairing the goods; and
  • otherwise, the maximum extent permitted by law

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profit or opportunity, except where such liability cannot lawfully be excluded.

Termination does not affect any rights or obligations accrued before termination.

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and any courts entitled to hear appeals from those courts.
